An Army veteran recently returning from serving for a year in Afghanistan is now being sued by his Homeowner’s Association…for having a swing set in his backyard for his young children.
CBS Houston reported that Army National Guard Captain Bill Fry is being sued by The Spring Lake Homeowner’s Association for “not getting approval to put up the swing set.”
Captain Fry told WFAA-TV that, “The way the homeowner’s association has treated us and portrayed us to our neighbors, it has caused a fairly sizable rift.”
Fry’s wife, Candi, claims permission was given last year to build the $1,200 set in their yard, but the homeowner’s association disagrees citing that it is “not in harmony with the design and location in relation to surrounding structures and topography,” according to the Mineola Monitor.
HOA Chairman Harold Lemmon said, “They’re in the wrong only because they declined to make the proper application and submit the drawings.”
Capt. Fry claims that “not once before or even during construction was anything mentioned” about submitting any forms or documentation for the children’s play set.
